These are the rules for using ALTO/WIND. They are short on purpose. By creating an account or using the app, you agree to them and to our Privacy policy.
01What ALTO/WIND is
ALTO/WIND is an iPhone app (“Wind” on your home screen) that shows live wind measured by anemometers installed at kitesurfing spots, beach cameras, tides and a 9-day forecast, and lets you keep favorites, compare spots and, with an Apple Watch, record your sessions on the water. ALTO/WIND is offered by E-DEW, LLC, a company incorporated in the State of Delaware, United States, with its address at 1111 South Governors Avenue, 39424, Dover, DE 19904.
The anemometers and cameras are not ours: they are installed and maintained by third parties, and the data reaches us through a provider. We do not control where the sensors are, how they are calibrated or when they go offline.
02Safety: read this carefully
Kitesurfing is a dangerous sport and can cause serious injury or death. The decision to go in the water, when, where and with which gear is yours alone.
- Wind readings can be wrong, delayed or offline. A sensor can drift out of calibration, lose its signal or keep showing its last reading for a while. Cameras can freeze or show an old image.
- The forecast is an estimate and gets things wrong. Wind changes within minutes and varies along the same beach.
- The wind bands (such as “rideable”, “good” or “strong”), the wind's direction relative to the beach (such as “ideal” or “dangerous”) and the kite size suggested for your weight are generic estimates, meant as guidance. They are not safety advice for you or your gear.
- Always check conditions on site before going in the water, follow local rules and warnings and the guidance of instructors and schools, and use suitable, well-maintained gear.
- Never rely on the app alone to decide whether it is safe to ride.
03Your account
- You need an account to use the app. You sign in with Google or, when available, with Apple. Each one creates a separate ALTO/WIND account.
- You must be at least 13 to have an account. Anyone under 18 should use the app with a parent's or guardian's knowledge.
- Your account is personal. Look after access to your device: what is done with your account is your responsibility.
- You can delete your account whenever you want, under Account → Delete account.
04Price
ALTO/WIND is free today. If a paid plan ever exists, we will tell you beforehand, and nothing is charged without your acceptance.
05Acceptable use
By using ALTO/WIND, you agree not to:
- use the app for anything unlawful;
- scrape data or access the service with bots, scripts or other automation;
- get around usage limits, sign-in or other security measures, or try to access other people's data;
- resell, redistribute or republish the wind data, the forecasts or the camera video;
- overload or disrupt the service.
06The app and the wind data
The app, the ALTO/WIND brand, the design and the code are ours. Wind data, forecasts, photos and camera video belong to their sources. You may use ALTO/WIND for personal purposes, under these terms.
07Availability and changes
We work to keep ALTO/WIND available, but it may be down for maintenance or because of failures, ours or of the services we depend on, such as the sources of the wind data. We may change, add or remove features and spots.
If we change these terms in a significant way, we will tell you before the change takes effect. The version in force is always the one on this page.
08Ending
You can stop using ALTO/WIND and delete your account at any time. We may suspend or close an account that breaks these terms, telling you whenever possible.
09Liability
We build ALTO/WIND with care, but you are the one who decides to go in the water. To the extent the law allows, we are not liable for harm caused by decisions based on the app alone, nor for wrong, delayed or unavailable readings, forecasts or images that come from third-party sources.
Nothing in these terms limits the rights Brazil's Consumer Protection Code gives you.
10Law and venue
These terms are governed by the laws of Brazil. Any dispute may be brought before the courts of the consumer's place of residence.
